Confirm Who Is Responsible Before You Chase an Answer

A condo’s management office, the Joint Management Body (JMB), the Management Corporation (MC), and a hired property management company are not necessarily the same thing. The management office may handle phone calls, arrange repairs, and collect documents, but the body that is legally responsible for the common property depends on what stage the development has reached.

Knowing which name applies lets an owner work out who sets the fees, who holds the accounts, and who to follow up with when something in the common areas goes wrong.

This article covers the strata management system that applies in Peninsular Malaysia and Labuan. Sabah and Sarawak have their own rules and are not covered here.

The JMB Does Not Automatically Take Over on Handover Day

The JMB (Joint Management Body) is made up of the developer and the purchasers, and it comes into existence when the first JMB annual general meeting (AGM) is held. Before that meeting, the developer is generally responsible for management under the applicable rules.

For projects where Vacant Possession (VP) is delivered after the relevant Act came into force, the developer is generally required to call the first JMB AGM within 12 months of VP delivery. Receiving the keys to a unit should not be read as meaning the JMB has already taken over.

Not every project goes through a JMB stage at all. If the Management Corporation (MC) is already formed before the first JMB AGM would otherwise be held, the Act allows the project to skip the JMB stage and move straight into MC-stage management.

MC Formation Does Not Mean the Handover Is Already Complete

The Management Corporation (MC) is formed in connection with statutory steps such as the opening of the strata register, and its members are the owners of the individual strata units, not simply a handful of elected committee members.

The formation of the MC, the holding of its first AGM, and the actual handover of accounts and documents are three separate events. Where a project was previously managed by a JMB, the JMB generally dissolves around three months after the first MC AGM, and it must hand over funds, documents, and other records within the statutory deadlines.

So when an owner hears that strata titles have been issued, the next step is to confirm who currently issues invoices, who holds the management account, and whether the first MC AGM and the handover have actually been completed, rather than assuming this from the date strata titles were issued alone.

How a Management Body, a Committee, and a Management Company Divide the Work

Term Main Role
JMB / MC Carries the statutory management duties, including maintenance of common property, collecting fees, and keeping accounts
Management committee Handles the body’s affairs under the law, AGM resolutions, and delegated authority, but is not the management body itself
Appointed property management company Carries out day-to-day work within its mandate, such as arranging contractors, keeping accounts in order, and following up on complaints
Management office staff The day-to-day point of contact; whether they can approve spending or change policy depends on what authority they have been given

Hiring a management company does not transfer all of the JMB’s or MC’s statutory duties to that company. Conversely, when an owner has a complaint, it is worth distinguishing between a service-delivery problem and a matter that can only be decided by the AGM or the management body itself.

Owners Should Watch the AGM and the Accounts, Not Just Pay the Bill

The annual general meeting covers the budget, fees, election of committee members, and other management matters. Owners who live abroad can confirm in advance how they will be notified and what the procedure is for attending in person or appointing a proxy.

Voting eligibility, restrictions linked to unpaid fees, and proxy requirements must be handled according to the law and the meeting notice that applies at the time; it is best not to leave the paperwork until the day of the meeting.

When reviewing information, it helps to start with the annual accounts, the budget, arrears, and any major works resolutions. If there is a question, putting the item, amount, or date in writing is easier to trace than arguing about it in a residents’ chat group.

If Something Goes Wrong, Keep a Record You Can Follow Up On

For problems such as leaks in common areas, lift breakdowns, or security issues, start by submitting the location, photos, the time it happened, and the impact to the management office, and ask for a response on how it will be handled.

For questions about the basis for charges, the accounts, or AGM procedures, submit a written query to the relevant management body. If the matter is still unresolved, look into routes such as the local Commissioner of Buildings (COB) or the Strata Management Tribunal, depending on the nature of the dispute.

Not every complaint is handled by the same authority. Matters involving private tenancy agreements, criminal issues, or other legal disputes may need to be handled differently.

Common Misunderstandings

“The JMB Automatically Takes Over After Handover”

Confirm the first AGM and the management stage first. In some projects the developer continues to manage, while others move straight into the MC stage.

“The MC Is Just a Committee Made Up of a Few Owners”

The MC is a statutory management body; the elected management committee handles its affairs. The two should not be treated as the same thing.

“Once the Management Company Changes, the Old Accounts No Longer Need to Be Chased”

A change of management company still requires accounts, funds, and documents to be handed over properly; unresolved issues do not disappear just because the company changed.

What to Check Next

A new owner can start by asking the management office for the name of the current management body, its contact details, fee notices, and the most recent AGM information, to confirm who to pay and who to query.

Anyone buying a resale unit should look beyond the common facilities and also check the management handover status, the accounts, and any arrears. If the project is in the process of moving from JMB to MC, it is worth checking the handover progress specifically.

Frequently Asked Questions

Can the JMB and the MC Be Used Interchangeably?

No. They belong to different statutory management stages, and which one applies depends on the project’s strata registration, AGM history, and handover status. It is not a matter of choosing a name.

Does the JMB Dissolve as Soon as Strata Titles Are Issued?

No, the date strata titles are issued is not the only factor. Where a JMB already exists, its dissolution and the handover process follow the first MC AGM and the statutory procedure.

Can a Management Company Decide All Management Issues?

No. A management company acts within its mandate; certain matters still require a decision by the management body or the owners’ AGM under the applicable procedure.
