The Department of Homeland Security has finalized new filing fees for the EB-5 Immigrant Investor Program, published in the Federal Register as a final rule (91 FR 61940, Docket USCIS-2025-0139) and effective November 30, 2026. Any EB-5 application, petition, or request postmarked on or after that date must use the new fee schedule.
For regional-center investors, the Form I-526E filing fee rises from $3,675 to $7,850 — a 114% increase. Combined with the separate EB-5 Integrity Fund fee, which rises from $1,000 to $1,100, the total due at initial filing climbs from $4,675 to $8,950. Standalone investors filing Form I-526 see the fee rise from $3,675 to $7,615, up 107%. Form I-829, used to remove conditions on permanent residence, rises from $3,750 to $5,000. The new I-526/I-526E fees also build in a new $75 EB-5 Technology Fee. DHS says the additional revenue will fund petition processing, background and compliance checks, investment-project reviews, audits and site visits, and program-integrity work required under the EB-5 Reform and Integrity Act of 2022.
The fee rule does not change the minimum EB-5 investment thresholds themselves, which remain $800,000 for projects in targeted employment areas or qualifying infrastructure projects, and $1,050,000 for other qualifying investments. A separate, already-scheduled inflation adjustment will raise those thresholds to $937,500 and $1.25 million respectively from January 1, 2027 — meaning investors who file before that date lock in the lower investment amounts, even though they must already pay the higher filing fees from November 30.
