Beyond the Price: A First-Time Foreign Buyer’s Malaysia Cost Checklist

A property-buying budget can be split into two tables: one for how much cash is needed by signing, financing and completion, and another for the costs of holding and eventually selling the property.

One point should be clarified first: the deposit and the down payment are usually part of the sale price, not costs on top of it. If there is a loan, how much of the price has to be paid in cash at the time of purchase depends on the actual loan amount approved and the payment arrangement.

Beyond the sale price itself, the following costs should be checked one by one.

At Purchase: Taxes, Legal Services and Loan-Related Costs

Item What to Confirm in the Budget
Property transfer stamp duty Calculated based on the applicable instrument, the buyer’s status, the property category and the rules in effect at the time; cannot be assumed to match another buyer’s case
Sale and transfer legal fees What contract, transfer or assignment work the quote covers, and whether anything is charged separately
Loan instrument stamp duty and legal fees Checked separately when there is financing, kept apart from the sale transaction’s fees
Search, registration and other disbursements Ask for these to be itemized, rather than lumped into an unspecified “miscellaneous” line
State consent-related fees Where an approval application is required, confirm the application fee, approval fee or other applicable levy, and who bears it
Valuation and bank fees Depends on the loan product and the property; ask the bank for a written breakdown
Insurance or takaful costs Confirm what is covered, whether it is a loan condition, and whether the premium is added to the loan
Applicable service tax Confirm whether professional service quotes already include tax

Do Not Simply Add the SPA and MOT Legal Fees Together

The SPA is the sale and purchase agreement; the MOT is the memorandum of transfer, which is a transfer document, not the name of a tax.

Under the Solicitors’ Remuneration Order (SRO) 2023 that applies in Peninsular Malaysia, the standard legal fee for an ordinary sale and purchase transaction already covers the normal work needed to complete the transaction, including drafting the SPA and preparing and registering the transfer document, or handling a deed of assignment where an individual or strata title has not yet been issued.

So it should not be assumed that a full separate legal fee is charged for the SPA and then another full fee for the MOT. Loan documents, a later formal transfer once title is issued, and other additional work may be charged separately, and the lawyer should explain the scope and basis for any such charge. Fee rules in Sabah and Sarawak need to be checked separately.

Check Stamp Duty Against Your Own Status as a Foreign Buyer

Property transfer stamp duty is not exclusive to foreign buyers, but the treatment that applies to a foreign buyer may differ. Non-citizen status, permanent residence, a corporate buyer, and the property type and the date of the instrument can all affect the calculation.

An old calculation found online, or a citizen first-time-buyer incentive, should not be assumed to apply directly. Ask the lawyer to provide the tax amount and the basis for the calculation for the actual transaction.

Before and After Handover: Renovation, Deposits and Move-In Preparation

This is the part most easily left out of an initial budget. On top of legal and bank fees, it is worth setting aside funds for:

  • Inspection, repair and renovation costs
  • Furniture, appliances, curtains and moving costs
  • Connection fees or deposits for water, electricity, internet and similar services
  • Renovation deposits, move-in deposits or other fees required by the management office
  • Maintenance fees and other amounts payable in advance at handover

Refundable deposits and non-refundable costs are best recorded separately. A deposit may not end up being a final cost, but it still ties up cash at the time.

If the funds are being remitted from overseas, bank remittance fees and the exchange rate spread also need to be factored in. For a transaction paid in installments, the effect of exchange rate movements on the unpaid balance should also be considered.

During Ownership: Loan, Management, Taxes and Maintenance

When holding costs start to apply depends on the contract and the handover arrangement; it does not necessarily wait until formal title registration is complete.

Item Key Point to Check
Loan installment and interest A cash flow budget should include the full monthly installment; when analyzing financing costs, separate principal from interest
Management fee and sinking fund For strata property, confirm the fee, the billing cycle and any additional levies separately
Land tax or strata land tax Confirm which one actually applies to the property, to avoid double counting
Assessment tax Confirm with the local authority or an existing bill
Building and home insurance Find out what cover the management body already has, and what an individual owner still needs to add
Routine maintenance and equipment replacement Set aside a variable amount for things like air-conditioning, water heater or indoor leak repairs
Utilities, internet and other service fees Estimate based on whether the property is owner-occupied, rented out or vacant

Land Tax and Strata Land Tax Are Not Always Both Payable

Some states have introduced a strata land tax (Cukai Petak) for applicable strata properties, replacing the previous land tax arrangement. Under Selangor’s official explanation, for example, the strata land tax is a replacement system and should not be treated as an extra land tax charged on top of the existing one.

Assessment tax (Cukai Taksiran / Cukai Pintu) is a separate item and should not be confused with the land tax items above.

Check What Insurance Actually Covers, to Avoid Gaps or Duplication

A strata property may already have building insurance arranged by the management body, but that does not mean interior contents, renovations or all personal liability are covered.

Mortgage-related cover, such as MRTA, MLTA or the corresponding takaful products, is also different from building fire insurance. Whether it needs to be purchased, how the premium is paid, and whether declining it changes the loan terms should be confirmed with the bank.

If renting the property out is planned, vacancy periods, letting agent fees, rental management and the applicable rental income tax should also be budgeted for separately; rental income should not be treated entirely as net profit.

At Eventual Sale: Estimate the Net Proceeds First

Selling may involve:

  • Agent commission and legal fees
  • Loan redemption, discharge of charge or related document fees
  • Any applicable early redemption fee
  • RPGT and other amounts that need to be settled or apportioned

RPGT is calculated based on the chargeable gain, the seller’s status, the holding period and any applicable exemption; it should not be reduced to “a non-citizen who made a gain always pays under the same rule.” Whether a non-citizen holds Malaysian PR status can also affect the general tax rate category.

The amount the buyer withholds and remits under Section 21B is applied against the seller’s RPGT. When estimating the final cost, it should not be added again on top of the full RPGT amount; but when planning the cash flow around the sale, the time the funds are withheld and the possible wait for a refund still needs to be considered.

When Asking for a Quote, Have the Other Party List These Five Columns

Every cost item can be checked using the same format:

Item name | Basis for calculation | Estimated amount | When payable | Who bears it

Also note whether it includes tax, whether it is refundable, and whether it is already included in another quote.

Where a developer offers a “free legal fees” or “free stamp duty” promotion, check exactly which documents and costs it covers. Waiving one item does not mean there are no other costs in the transaction.

Frequently Asked Questions

Is the total buying budget just the price plus the down payment and miscellaneous fees?

No. The down payment is usually already included in the sale price. The cash needed at purchase should be calculated from the self-funded portion of the price, additional taxes and fees, move-in preparation, and deposits, without counting the down payment twice.

Is the loan instrument stamp duty the same as the property transfer stamp duty?

No, they relate to different instruments. Where there is a loan, they should be listed separately, and it is worth confirming whether any exemption applies to either one.

The new launch advertises free legal fees. Do I still need to prepare other costs?

Usually yes, each item still needs to be checked. The promotion may only cover specified legal services, and may not include stamp duty, loan documents, registration, disbursements or a later formal transfer of title.

Do I need to pay the cost of eventually selling at the time of purchase?

Generally no, but it should be estimated up front when assessing long-term returns, rather than looking only at the difference between the purchase price and the expected sale price.

Disclaimer

This article provides a cost-checking checklist and does not replace an actual transaction quote. Actual taxes, legal service fees and holding costs need to be confirmed based on the buyer’s status, the property’s location, the contract and the loan terms.
