Whether a foreigner can do a particular job in Malaysia depends on the pass category, the actual duties involved, and any industry or local-government requirements, all at once. An employer being willing to hire, or a salary meeting the published threshold, does not by itself mean an application will be approved.

An Employment Pass (EP) lets its holder work for the company named on the pass. It does not grant the freedom to switch jobs at will, work part-time, or run another business. Some jobs also involve professional registration or business licensing, so an EP alone cannot be treated as proof that the work is lawful.

Front-Line Service Work: Check Which Pass Category the Restriction Applies To

Malaysia’s Immigration Department explicitly states, as a condition of the Visit Pass (Temporary Employment) — VP(TE), often called PLKS — that its holders may not work as front liners.

This is a restriction tied to a specific pass category. It should not be read as “no foreigner can do customer-facing work,” and it should not be used to conclude that all retail, front-of-house restaurant, or reception jobs are automatically closed to EP holders.

If a job offer involves cashiering, reception, sales, or food service work, it is worth asking the employer to confirm:

  • Is the application for an EP, or for a VP(TE)/PLKS?
  • Does the position applied for match the actual day-to-day duties?
  • Does the industry or premises have any additional hiring restrictions?

A job title such as “supervisor” or “manager” on its own does not establish eligibility; the actual duties still need to be checked.

Hawker and Stall Work: Local Licenses Can Carry Explicit Restrictions

Hawker work is subject to local-government licensing conditions in addition to any work pass.

In Kuala Lumpur, for example, Dewan Bandaraya Kuala Lumpur (DBKL) requires hawker license applicants to be Malaysian citizens. Its hawker license FAQ also explicitly states that licensed hawkers may not employ foreigners as stall assistants.

So in Kuala Lumpur, a stall already having a locally licensed operator does not mean a foreigner can lawfully work at that stall.

That said, a hawker license is a different category from a general commercial-premises license. DBKL has separate arrangements and restrictions for certain non-citizen applicants for commercial-premises licenses, so the hawker rule should not be broadened into “foreigners cannot run any small business.” Other cities have their own local-government rules that need to be checked separately.

Professional Work: Holding an EP May Not Be Enough to Practice

Professional, technical, or managerial positions are not approved on salary alone. Some professions are also governed by their own regulatory bodies.

Practicing medicine in Malaysia, for example, requires meeting the Malaysian Medical Council’s (MMC) registration and applicable practice requirements. Getting a work pass does not substitute for professional registration, and holding an overseas qualification does not mean someone can practice locally right away.

These are two separate things to check: whether you are authorized to work in Malaysia, and whether you are qualified to practice that profession.

Local-Hiring Preference Mainly Shows Up in Recruitment and Approval Steps

Malaysia’s system for hiring foreign secondees includes arrangements that give priority consideration to local talent. For applications where this applies, the employer must advertise the vacancy through MYFutureJobs and carry out local recruitment and interviews as required.

However, official rules also list exemption categories, so it should not be stated broadly that “a foreigner can only be hired if absolutely no local candidate can be found.”

For a job candidate, the more useful question is whether the company has already confirmed which recruitment procedures apply to this position, whether it qualifies for an exemption, and which authority needs to approve it. An exemption from the recruitment procedure also does not mean the EP itself is automatically approved.

What to Confirm Before Accepting an Offer

Rather than asking only “can a foreigner do this job,” it helps to ask HR directly to clarify the following:

Actual job duties Whether the offer letter, application details, and day-to-day duties match
Position approval Whether industry-authority approval or support is required
Local recruitment requirement Whether the vacancy must be advertised, interviews arranged, or an exemption applies
Other qualifications Whether local licensing, professional registration, or a practicing license is involved

If the company’s only answer is “it’s fine as long as the salary is high enough,” that is not sufficient to confirm the position is workable. Ask them to explain further what the application is based on and what approvals are needed.

FAQ

If my salary meets the EP Category I threshold, can I apply for any job?

No. Salary is only one condition. The position still has to meet approval requirements, employer eligibility, and any other applicable rules. A high salary does not exempt a job from local licensing or professional-practice restrictions.

Can a foreigner work as a restaurant server or chef?

This cannot be decided from the job title “server” or “chef” alone. It requires checking the pass category, the specific duties, food-service industry requirements, and the premises’ license. Immigration’s front-line-work restriction is written specifically for VP(TE) holders; it cannot be used to conclude that every foreign chef qualifies for an EP, or that every EP holder is subject to the same restriction.

Is there one nationwide list of jobs foreigners cannot do?

The official sources referenced in this article do not provide a single list covering every pass category, industry, and region. The restrictions are spread across different systems, so each job needs to be checked individually rather than matched against a job title alone.
