Property Type Determines Which Rules Apply, Not Whether You Can Buy

Foreigners in Malaysia can consider condominiums, as well as terrace houses, semi-detached houses, and bungalows that meet certain conditions. But whether a purchase is actually allowed depends on the property’s location, price threshold, land title and permitted use, unit-specific restrictions, and the government approvals required.

In areas where the National Land Code applies, foreigners generally need state government consent to acquire real estate. Sabah and Sarawak have their own land laws and rules on foreign land purchases, so requirements from Peninsular Malaysia cannot be applied directly there.

So “foreigners can buy condos” is only a starting point. It does not replace verification of the specific unit, and meeting the price threshold does not mean other restrictions have been lifted.

Condominiums and Serviced Apartments: Check Unit Eligibility and Approved Use

Condominiums are a common option for foreign buyers, but within the same building, individual units may still be subject to Bumiputera quotas or other sale restrictions. When viewing a unit, confirm that it meets the local foreign-ownership requirements, rather than relying on the development being marketed as “open to foreigners.”

Serviced apartments cannot be judged by name alone. A lawyer should verify the land use, approved use, and title documents to confirm how the unit is classified under local property rules and whether it matches your intended use.

“Allowed to buy” and “allowed to use as you intend” also need to be confirmed separately. For example, if you plan to operate short-term rentals, you still need to check local regulations and the building’s management by-laws.

Landed Property: Terrace Houses, Semi-Detached Houses, and Bungalows Vary by State

Terrace houses, semi-detached houses, and bungalows are not entirely off-limits to foreign buyers, but some states impose additional restrictions on these residential types, and price thresholds may differ from those for condominiums.

Another easily overlooked distinction is the form of title: two properties that look like the same type of terrace house or bungalow may have individual titles, or may be landed strata titles. Under some states’ foreign-ownership policies, the two can be treated differently.

So when asking an owner or developer, do not stop at “can a foreigner buy this.” Also obtain the title or relevant project documents so a lawyer can confirm the property type, title form, and applicable conditions.

Land: Vacant Land Does Not Automatically Come With Building Rights

If you are considering buying land to build on, the checks involved are broader than for buying an existing home. Land designated for residential building, agricultural land, and industrial land are not subject to the same rules for purchase and use.

Agricultural land in particular should not be treated as cheaper land for housing. Foreign interests acquiring agricultural land are subject to specific conditions and state policy; even if a transaction appears to have room for approval, that does not mean residential construction is automatically permitted.

Before buying vacant land, check the land use category, the conditions stated on the title, the planning designation, and the approvals required to build. A seller’s assurance that “the use can be changed later” is not the same as that change having actually been approved.

Properties Generally Not for Sale to Foreigners

The categories to check for first include:

  • Low-cost and low-medium-cost housing as defined by state governments; other affordable housing schemes have their own buyer-eligibility rules to check separately.
  • Property on Malay reserve land.
  • Units in developments still subject to Bumiputera quota restrictions (Bumi lots).

Not every lower-priced home qualifies as “affordable housing,” and price alone should not be used to judge whether a property is restricted. Check the official classification and scheme conditions instead.

Some states have a process for releasing Bumiputera-quota units, but “eligible to apply for release” is not the same as “approval already obtained.” Even where a sale to a non-Bumiputera buyer is approved, you still need to confirm whether this specific transaction is permitted and whether the other purchase conditions are met.

Common Misunderstandings

Misunderstanding 1: If the Developer’s Condo Can Be Bought, Its Terrace Houses Should Be Too

Different property types and title forms can be subject to different conditions. Coming from the same developer or the same development does not replace verification of the specific unit.

Misunderstanding 2: This Condo Already Has Foreign Owners, So I Don’t Need to Check Again

Other foreign owners’ transactions may involve different units, approval conditions, or timing. You should reconfirm based on the specific unit you intend to buy and the rules currently in force.

Misunderstanding 3: The Owner and Agent Both Say It’s Fine, So State Approval Is Just a Formality

A verbal assurance is not a substitute for formal approval. Before transacting, understand what consent is required, the application conditions, and how the contract and deposit are handled if approval is not granted. Do not assume approval will go through.

How to Approach the Next Step

If You Are Looking at a Condominium or Serviced Apartment

First confirm whether the unit is open to foreign buyers, then check the price threshold, permitted use, quota status, and required approvals. If the strata title has not yet been issued, also check the master title and related project documents.

If You Are Looking at a Terrace House, Bungalow, or Land

First confirm the title form and land use, then check local restrictions on foreign purchase of that property type. If you plan to buy land and build, also factor planning and construction approvals into your assessment.

If You Are About to Pay a Deposit or Sign a Contract

Have a lawyer verify purchase eligibility and the transaction documents first, and confirm the refund terms in case government approval is not obtained. Taking this step before payment reduces the risk of disputes later.

FAQ

Can foreigners buy a condominium in Malaysia?

Foreigners can consider condominiums that meet the relevant conditions, but should still check the local price threshold, unit-specific restrictions, and government approval requirements. The label “condominium” alone does not guarantee that a purchase is allowed.

Can foreigners buy a terrace house or bungalow?

It depends on the location and the form of title. Some states impose additional restrictions on landed housing, and individual titles versus landed strata titles may be treated differently, so this should be confirmed before signing.

Can foreigners buy land and build their own house?

Not necessarily. You need to confirm both whether the land can be acquired by a foreigner and whether the approved use permits the residential building you intend. Approval to buy land is not the same as approval to build, and agricultural land cannot be used as residential land without separate authorization.
