Two Things to Verify Before You Buy

Foreigners buying property in Malaysia need to confirm two separate things before signing anything: whether the specific property meets the conditions for foreign ownership, and which government approvals the transaction requires.

Neither one substitutes for the other. A property priced above the foreign-ownership price threshold does not mean the land or the unit is free of restrictions. Likewise, a project marketed as “open to foreign buyers” does not mean your particular transaction has already secured the approvals it needs.

The check should be done against the specific unit, the buyer’s status, and the transaction documents, not just on the general fact that other foreign buyers have purchased in the same development before.

Property Type Restrictions: Confirm the Unit Qualifies

Before committing to a purchase, verify the property against each of the following categories:

  • Low-cost and medium-low-cost housing as defined by the state government, and affordable-housing schemes that carry their own buyer eligibility rules.
  • Property on Malay reserve land.
  • Units still subject to Bumiputera quota restrictions (“Bumi Lots”).
  • State-specific restrictions on foreign purchases of landed housing, land, or other property categories.
  • The foreign-ownership price threshold that applies to that area and property category.

Affordable housing is a scheme or policy classification, not something you can determine from the sale price alone. Even where a Bumi Lot is said to have had its quota lifted, you should confirm that the formal approval actually covers this specific unit and this specific foreign-buyer transaction.

Beyond requesting information from the developer or seller, a lawyer should review the land title, the land registry, and any related approval documents. Where an individual or strata title has not yet been issued, the master title and project documents need to be checked as well.

State Consent: Work Out Which Approval You Need

In areas where the National Land Code applies, a foreigner acquiring real estate generally needs prior state government approval under Section 433B. Even if the title contains no transfer restriction, that does not mean a foreign buyer is exempt from applying.

Separately, if the title itself carries a restriction such as “consent required before transfer,” a second, distinct transfer-consent approval may also apply. The approval required for a foreigner to acquire property and the transfer consent required under a title restriction rest on different legal grounds. Whether these are combined into one application, which form is used, and who handles it should be confirmed against the procedure in that specific location.

Sabah and Sarawak each have their own land laws and their own rules for property acquisition; the procedures used in Peninsular Malaysia do not carry over directly.

Getting approval is also not the same as completing the transaction. After consent is granted, payment, document signing, and the applicable title registration steps still need to be completed in line with the approval conditions and the sale and purchase agreement.

Approval Timelines and Contract Terms to Align

There is no single processing time for state consent that applies to every transaction across Malaysia. The application category, whether documents are complete, any requests for additional information, and the reviewing authority’s own pace can all affect how long it takes.

A more practical approach is to have a lawyer confirm the following before signing:

  • Who prepares and submits the application, and what documents each party needs to provide.
  • The application fee and any fees payable after approval, and which party bears them.
  • How much time the contract allows for obtaining approval, and whether an extension is possible.
  • How the transaction is terminated if approval is not granted, how any deposit is refunded, and how costs are split.
  • How the deadline for the final payment is calculated, and whether it is tied to the approval being granted.

These points should be written into the applicable transaction documents. Do not assume that all monies are automatically refunded if an application is rejected, and do not treat another transaction’s approval timeline as a reliable estimate for your own payment schedule.

Common Misunderstandings and Practical Notes

Misunderstanding 1: “This Property Looks Fine, So There’s Nothing Special to Check”

Appearance, renovation, and location do not reveal title restrictions or quota status. Different units within the same development can carry different conditions, so the check has to match the specific unit you intend to buy.

Misunderstanding 2: “State Consent Usually Goes Through, So It’s Fine to Sign First”

A transaction can be structured with conditional contract terms, but a lawyer should confirm beforehand how the contract handles approval, deadlines, and refunds. What matters is understanding, before signing, what obligations you are taking on, rather than treating “it will probably be approved” as a guarantee.

Misunderstanding 3: “A Freehold Title Has No Transfer Restrictions, So Foreigners Don’t Need to Apply”

Freehold describes the tenure of the land; it does not substitute for the eligibility and approval requirements that apply to a foreign buyer. Even where a title carries no general transfer restriction, the procedure that applies to foreign buyers still needs to be checked.

Misunderstanding 4: “I Found Similar Properties Online That Foreigners Can Buy, So That’s Enough”

Information found online is useful for understanding how the system works in general, but it may not reflect the latest state policy, the status of an individual unit, or your own eligibility as a buyer. A formal determination still needs to be based on a land search and the actual transaction documents.

What to Do Next, Depending on Where You Are

Still Viewing Properties: Get Verifiable Documents First

Request the unit’s details, a copy of the land title, and any related quota or approval documents from the seller or developer, and have a lawyer confirm eligibility to purchase. Do not pay a deposit based only on location and layout when the purchase conditions are not yet clear.

Preparing to Sign: Read the Approval and Refund Terms Closely

Confirm which approvals are required, who is responsible for the application, the applicable fees, the timeline, and how a rejected application would be handled. If financing is involved, the validity period of the bank documents should also be coordinated with the expected approval timeline.

Application Submitted: Keep the Receipt and Follow Up

Ask whoever is handling the application for the submission receipt and status updates, and respond promptly to any request for additional documents. Once approval is granted, check the validity period of the approval letter, the buyer and property details on it, and any conditions that still need to be fulfilled.

Q1: What is the most important thing to check before buying?

First confirm that both the property and the buyer meet the purchase conditions, then work out which government approvals are required. Also check the land title, land registry, and quota information, and confirm before signing how a failed approval would be handled.
