1.Holding a Thailand Elite Visa does NOT automatically make you a Thai tax resident. The determining factor is your physical stay duration:

  • Tax Residency Criteria: Under Section 41 of Thailand’s Revenue Code (2024 amended version), staying in Thailand for over 180 days within a calendar year classifies you as a tax resident, requiring declaration and taxation of global income.
  • Tax-Exempt Scenarios: If your stay falls below 180 days, only Thailand-sourced income (e.g., rental earnings, local business profits) is taxable. Overseas income remains exempt.
