Can You Back Out of a Dubai Tenancy Contract? Changing Your Mind Is Not Enough, but Proven Deception Before It Starts Can Be
A Dubai tenancy contract cannot be ended unilaterally once it is in force, under Article 7 of Law No. 26 of 2007, but on 29 October 2026 the Rental Disputes Center (RDC) announced a judicial principle that a signed lease can be annulled before it is implemented if one party proves it was deceived.
The principle comes from a single case. Gulf News, Khaleej Times and Al Bayan reported the RDC’s statement the same day. A landlord signed a lease with a company, then learned before handover that the company had faced rental cases over unpaid amounts and that its manager was subject to arrest and bring-in orders. The first-instance claim was dismissed. On appeal, the lease was annulled.

The most useful lesson is not that there is a new way out. It is that a free official tool lets you check the other party before you sign. This guide explains how a lease ends, how high the bar for annulment really is, and what to do as a landlord, a tenant, someone who has signed but not moved in, and someone already living in the property.
Key Points
- Who should read this: tenants in Dubai, people relocating to the city, landlords letting to companies or sub-letters, and overseas owners of Dubai rental property.
- There is no cooling-off period. The new principle covers deception only, and the person claiming it must prove it.
- The bar is higher than the headlines suggest: the law pairs deception with “gross unfairness”, and a past rental dispute does not automatically mean deception.
- The best step comes before signing: check the other party with the RDC’s free Rental Good Conduct Certificate, then verify the title deed and any broker’s licence.
How a Dubai Tenancy Contract Can End: The Legal Exits
A signed lease generally runs to the end of its term. These are the ways to end it early, and each rests on a different basis:
| Situation | Can it end? | Basis |
|---|---|---|
| One side changes its mind | No. Neither party may terminate unilaterally during the term | Law 26 of 2007, Article 7 |
| Both sides agree | Yes, ideally in writing | Law 26 of 2007, Article 7 |
| Grounds under the tenancy law | Yes. A landlord’s early eviction is limited to listed cases, such as rent unpaid 30 days after notice | Article 25, as amended by Law 33 of 2008 |
| Early termination clause | As the clause says. There is no fixed statutory penalty; Gulf News says one to two months’ rent is common where a clause exists | Gulf News, 21 October 2026 |
| Proven deception before implementation | Annulment can be requested and the RDC decides | RDC principle, 29 October 2026 |
Amended Article 4 also requires leases to be registered with the Real Estate Regulatory Agency (RERA), the step known as Ejari. The contract must state the property, purpose, term, rent and payment method, and must name the owner where the landlord is not the owner.
What Counts as Deception in a Dubai Tenancy Contract: Lying and Deliberate Silence
The appeal ruling relied on Articles 170, 171 and 173 of the Civil Transactions Law. The reports do not say which version. Checked against the official texts, those numbers match the “Deception and Unfairness” section of the new law in force since 1 June 2026. The same numbers in the 1985 law deal with legal capacity, and its deception rules sit at Articles 185 to 192.

In plain terms, the law has three layers:
- Deception (Article 170): one party uses fraudulent means, in words or conduct, to make the other agree to something they otherwise would not have.
- Deliberate silence (Article 171): hiding a fact counts as deception if it is proven the other party would not have signed had they known.
- Gross unfairness (Articles 172 and 173): Article 172 allows annulment where a party was deceived and the contract was concluded with gross unfairness. Article 173 defines unfairness as an imbalance between rights and obligations, and gross unfairness as an imbalance beyond the assessment of valuers.
This matters. The RDC’s public statement lists Article 173 but not Article 172, and does not explain how unfairness was assessed in this case. Neither the judgment nor a case number has been published, so the news should not be read as “prove deception and the lease is automatically annulled”.
The new law also has a second route. Article 122 requires parties to disclose information of decisive importance, including information directly connected to a party’s status. This duty cannot be excluded by contract, breach allows the aggrieved party to seek annulment, and the person alleging concealment must prove it. The reports do not mention this article, so ask a lawyer whether it fits your case.
After a Dubai Tenancy Contract Is Annulled
Under Article 188 of the new law, an annulled contract is treated as if it never existed. Article 192 restores both parties to their position before the contract, with compensation possible if that cannot be done. That is what the RDC ordered here.
Timing matters too. Under Article 191, the right to annul lapses if not used within one year, running from discovery in the case of deception, and it cannot be used 15 years after the contract was concluded. Under Article 189, express or implied ratification ends the right.
If your lease was signed before 1 June 2026, the position may differ. Article 4 of the new law says it does not apply retroactively, and law firms read that to mean older contracts generally stay under the 1985 law. Take legal advice in that case.
Before You Sign a Dubai Tenancy Contract: Check the Other Party for Free
The most useful step is the Rental Good Conduct Certificate. The RDC describes it as a service that lets parties review the other party’s rental case history within the RDC system before drawing up a lease.

| Item | Detail | Source |
|---|---|---|
| Who can check | Landlords can check tenants and tenants can check landlords, including companies | RDC statement; Gulf News |
| Where | Dubai REST app or the RDC website | RDC website |
| Cost | Free | RDC statement, 29 October 2026 |
| Timing | Instant | RDC website |
| Details needed | Individual: Emirates ID, name, mobile, email. Company: trade licence details and contact person | Gulf News, September 2025 |
| Other party’s consent | Media reports quoting the Dubai Land Department (DLD) say consent is needed; the RDC service page does not mention it, so follow the system prompts | Gulf News; Bayut |
Two limits apply. It covers rental cases in the RDC system only, so it is not a credit report or background check. A record also does not prove dishonesty: Gulf News notes that past rental disputes do not automatically mean a party acted dishonestly.
If You Are Letting to a Company or Sub-Letter
This case involved exactly that kind of tenant: a company that had rented property to sublet to others and had faced claims over unpaid amounts. Before signing, you can:
- Check the company’s rental history using its trade licence details, and ask who actually runs it.
- State in the lease whether the use is own occupation, staff housing or subletting. Under Article 24, subletting needs the landlord’s written consent unless agreed otherwise.
- If you allow subletting, agree the terms for subtenants. Under Article 8, a sublease ends with the main lease.
- If several people will share, read the Zagdim guide Is Dubai Shared Housing Legal? first.
- Ask for a written statement of any pending rental cases. If a dispute follows, that document is evidence.
If You Are Looking for a Home
| What to check | How | Basis |
|---|---|---|
| The landlord’s rental history | Rental Good Conduct Certificate | RDC website |
| Whether the title deed is valid | DLD Verify Title Deed, instant on the website or Dubai REST | DLD website |
| Whether the broker is licensed | DLD Verify License and Permits, and the list of licensed brokers | DLD website |
| Whether they can let the property | Amended Article 2 treats as landlord anyone entitled to dispose of the property, an agent, or a tenant permitted to sublet. Ask for a formal power of attorney or the owner’s written consent | Law 26 of 2007, as amended |
| Whether the contract is complete | The owner must be named where the landlord is not the owner | Amended Article 4 |
Before paying, make sure the payee matches the name on the title deed or power of attorney, and keep records of transfers and cheques. Without the landlord’s written approval of a sublease, amended Article 25 lets the landlord seek eviction of the tenant and the subtenant, who is left to claim compensation from the tenant.
Signed a Dubai Tenancy Contract but Not Moved In: What to Do
First separate deception from regret. Finding a cheaper flat or changing jobs is not deception, and those cases call for a negotiated exit. If the other party really did mislead you or hide something, this is a sensible order:
- Keep the evidence: adverts, messages, the contract, search results and payment records.
- Speak to a lawyer before taking handover, moving in or paying further. Under Article 189, implied ratification can end the right to annul, and whether those steps count depends on the case.
- Do not stop payments or cancel cheques on your own. Article 7 does not allow unilateral termination, so doing so could put you in breach.
- Contact the other party in writing, explain what you found and try to agree an exit. Agreement is the quickest route.
- If that fails, go to the RDC, whose services include amicable settlement and lawsuits. Check its latest notices for fees.
If a broker did the deceiving, there is one more hurdle. Under Article 176, where a third party commits the deception, you must prove the other contracting party knew about it.
On money, Article 192 restores both sides, and Article 238 lets each side hold on to what it received until the other returns what it received. Published sources do not say whether agency fees and Ejari fees can be recovered.
Already Living Under a Dubai Tenancy Contract: This Principle Does Not Cover You
The RDC’s principle refers to the period before implementation, and this case was decided on facts from before handover. Published sources do not say whether a lease can be annulled for deception after move-in, so do not rely on this principle. The reports also do not define whether implementation means the tenancy start date or handover, so take advice if you fall between the two.
More practical routes after move-in are:
- Agree an early exit, or use any early termination clause.
- If the home has serious problems or the landlord is in breach, document it and take it to the RDC.
- If the landlord cuts services or disturbs your use, Article 34 prohibits this. You can go to the police and claim damages from the tribunal.

Common Misunderstandings About Annulling a Dubai Tenancy Contract
“There is a cooling-off period.” There is not, and this principle does not create one. Gulf News is explicit that changing your mind is not enough.
“The other party has a record, so I can annul.” A record alone is not deception. There must be fraud or deliberate concealment, and you must show you would not have signed had you known.
“I saw the record but can still claim it was hidden.” Article 171 turns on what you would have done had you known. If you saw it and signed anyway, that claim would be hard to make.
“No record means it is safe.” The search covers rental cases in the RDC system only. Title deeds, licences and authority documents need separate checks.
“This only protects landlords.” The claimant in this case was a landlord, but the RDC’s statement covers both landlords and tenants.
Three Dubai Tenancy Contract Scenarios
These are illustrations, not actual cases.
An overseas owner letting to a company. An owner living in London is offered a company tenant for staff housing. She asks for trade licence details, checks rental history and writes the use and subletting limits into the lease. If the system needs the company’s consent, she asks for it before going further.
A new arrival checking a landlord. A newcomer finds a flat offered by someone who says he is subletting. She asks to see the owner’s title deed details and written consent to sublet, and verifies the broker’s licence. If the documents do not appear, she does not pay.
Signed, handover next week, and a problem appears. A tenant learns of a serious fact the landlord did not disclose. He keeps the evidence, writes to the landlord to propose an agreed exit and asks a lawyer whether it amounts to deception with gross unfairness. He does not cancel cheques on his own or rush to collect the keys.
Dubai Tenancy Contract FAQ
How long do I have to cancel a Dubai tenancy contract after signing?
There is no cancellation window. Under Article 7 of Law 26 of 2007, neither party can end the lease alone during its term. What the RDC announced is annulment for deception, not a cooling-off right. Under Article 191 of the new law, that right must be used within one year of discovering the deception.
Is the Rental Good Conduct Certificate free?
Yes. The RDC says the service is free, and its website lists the Dubai REST app and the RDC site as channels, with instant results. It shows rental case history within the RDC system. Media reports say the other party’s consent is needed, so follow the prompts in the system.
Can I annul a Dubai tenancy contract because the other party has rental cases?
Not on that alone. Gulf News makes clear that past disputes do not automatically mean deception. You would need to show fraud or deliberate concealment, and that you would not have signed had you known, and Article 172 of the new law also refers to gross unfairness. The RDC decides each case.
Do I get my deposit and rent back if the lease is annulled?
Article 192 of the new law restores both parties to their position before the contract, with compensation possible if that cannot be done, so money paid should in principle be returned. The RDC ordered restoration in this case. Published sources do not address agency or Ejari fees, so confirm those with the RDC or a lawyer.
Does this apply to a Dubai tenancy contract signed before 1 June 2026?
The reports do not say. The new law took effect on 1 June 2026 and Article 4 says it is not retroactive. Law firms read that to mean older contracts generally stay under the 1985 law, which has its own deception rules at Articles 185 to 192. Ask a lawyer which law applies to your lease.
Can tenants use this principle too?
They can raise it. The RDC’s statement covers landlords and tenants, and the articles are not limited to one side. Deliberately hiding a material fact that would have changed your decision is the kind of situation involved. You must prove it, before implementation begins, and the RDC decides the outcome.
Can I annul a lease that has not been registered with Ejari?
Published sources do not address this. Amended Article 4 requires registration with RERA, but the reports on this case do not mention registration status. If you have signed but not registered, check with the RDC or a lawyer before you act.
