For overseas buyers purchasing UK property, the biggest source of unease usually isn’t the price — it’s that the process isn’t transparent: what happens after an offer is made, when funds actually change hands, and at what point a buyer can truly say they’ve “bought” the property. The UK’s buying and selling system differs from Hong Kong and Taiwan habits in a few key ways: an offer is not legally binding, a solicitor drives the whole process, and signing and completion happen in two separate steps (this article follows the system in England and Wales; Scotland has its own missives procedure). This article lays out each step along a timeline and flags the preparation points specific to overseas buyers.

The Six-Step UK Home-Buying Timeline

Step What Happens Notes for Overseas Buyers
1. Offer accepted You make an offer through the agent; once accepted, it is not legally binding — either side can still withdraw This is when you should start instructing a solicitor
2. Instruct a solicitor (conveyancer) The solicitor handles title searches, the contract and the entire completion process Choose a solicitor experienced with overseas buyers
3. Searches and survey The solicitor carries out local searches; the buyer can arrange a survey With no one on the ground, the report becomes your main basis for judgment
4. Mortgage approval If borrowing, wait for the formal mortgage offer from the lender; the lender’s valuation is only for mortgage approval and does not replace the buyer’s own survey Prepare overseas income documents early
5. Exchange of contracts Both sides sign to exchange and pay the deposit — from this point, the transaction is legally binding Withdrawing after this risks losing the deposit
6. Completion The balance is paid, the transfer is completed and the keys are handed over; the solicitor handles the stamp-duty filing and land registration on your behalf Funds must be in place and cleared in advance

Three Preparation Points Specific to Overseas Buyers

Prepare for source-of-funds checks early. Solicitors and banks have anti-money-laundering obligations regarding overseas funds, and proof of the source of funds (savings records, proceeds from an asset sale, gift documentation, etc.) should ideally be organized before you even make an offer — leaving this until close to completion is the most common cause of delay for overseas buyers.

Leave time for signing and notarizing documents. Some documents must be signed in original, or even notarized, and international mail plus time-zone differences will stretch out every round-trip. Confirm with your solicitor whether e-signature or paper signing will be used, and how documents will be sent.

Decide how you’ll hold the property before you make an offer. Whether you buy in the name of a company or as an individual affects how stamp duty is calculated and your ongoing annual tax position — a company purchase has its own set of rules (see our separate article on Stamp Duty); the trade-offs across four different holding purposes are covered in a separate comparison article. If holding through a company, you’ll need to allow time to set the company up first and coordinate that with the pace of your offer.

One Rule to Note Ahead: Selling Later

It’s also worth knowing the other end of the process in advance: when a non-resident later sells a UK residential property, they must file and pay Capital Gains Tax within 60 days of completion — even if no tax is owed or a loss was made, the filing itself is still a legal obligation. Keep your purchase-cost documentation on file when you buy — you’ll need it to calculate the gain later.

FAQ: The UK Home-Buying Process

Can the seller back out after an offer is accepted?

Yes. Under the system in England and Wales, neither side is legally bound until contracts are exchanged — a seller accepting a higher offer (commonly known as “gazumping”) is not illegal. This is the biggest difference from the “locked in once you put down a deposit” habit in Hong Kong and Taiwan, and it’s also why the process needs to move at a brisk pace.

Can the whole transaction be completed without ever visiting the UK?

Generally, yes. Searches, signing and completion are all handled by the solicitor on your behalf, and documents can be signed remotely or by post; the survey is carried out by a surveyor on your behalf. Whether any particular document needs notarizing or special arrangements depends on your solicitor’s requirements.

What needs to be done right after buying?

The stamp-duty filing and land registration are handled by your solicitor at completion. After that, you move into the holding phase: run through a landlord compliance checklist (certificates, deposit protection, etc.) before letting the property, and rental arrangements involve the Non-Resident Landlord Scheme (NRLS) — each of these is covered in its own dedicated article.

The UK home-buying process isn’t mysterious — it simply runs at a different pace from Hong Kong and Taiwan: uncertainty remains right up until exchange of contracts, and both sides are bound the moment contracts are exchanged.
