How Malaysia’s Withholding Tax Applies to Payments Abroad

Decide Whether a Payment Is Taxable Before Checking the Treaty

When a payer in Malaysia makes certain payments to a non-resident, such as interest, royalties, service fees, or dividends, the payer may have a withholding and remittance obligation under Malaysian domestic law. A tax treaty, also called a double taxation agreement (DTA), can limit how much tax the source country is allowed to charge, but looking only at a treaty’s rate table and skipping the domestic classification and exemption rules is a common mistake.

The first things to establish are who is being paid, why the payment is being made, what the service or right actually covers, and which jurisdiction the recipient is a tax resident of.

Common Rates Are a Starting Point, Not the Final Answer for Every Payment

Payment Common Domestic Starting Rate Still Need to Confirm
Non-resident interest 15% Source rules, specific exemptions (such as for banks), and treaty eligibility
Non-resident royalties 10% What rights are granted, how the payment is defined, and the treaty’s terms
Specified categories of income 10% Whether it falls under that statutory category, where the work is performed, and applicable exemptions
Dividends from a Malaysian company (general case) Generally no withholding A separate personal dividend tax, exemptions, and treaty limits apply

This table does not cover every type of payment to a non-resident. Non-resident contract payments, for example, are subject to separate rules and cannot simply be treated the same way as a general service fee.

A Service Fee’s Invoice Label Does Not Decide How It Is Taxed

An invoice description such as “consultancy fee,” “technical support,” or “software fee” can cover very different arrangements. What matters is whether the payment is for a service, for the right to use intellectual property, for equipment rental, or for some combination of these.

Where a particular service is actually performed, and any exemptions that apply to it, also affects the outcome. Being paid from overseas does not automatically mean a 10% rate applies, and having all the services performed overseas cannot be used as a blanket reason to exclude other categories, such as royalties, either.

Once the domestic tax treatment is confirmed, the next step is to check whether the treaty has a technical services article, or whether the payment should instead be handled under the treaty’s business profits or permanent establishment rules.

A Treaty Rate Is a Ceiling, Not a Floor

The percentage figures commonly seen in a tax treaty are a ceiling on how much the source country can tax, not an additional tax layered on top of domestic law. If domestic law already exempts a payment, a treaty listing 10% does not mean 10% must still be withheld. And if a treaty’s ceiling happens to be higher than the domestic rate, that does not mean the rate has to be raised to match it.

To actually claim the lower, treaty-based treatment, the recipient’s tax residency, how the income is classified, and related conditions, such as beneficial ownership and anti-abuse rules, all need to be confirmed. Rates under one jurisdiction’s treaty cannot simply be carried over and applied under another.

Get the Residency Certificate From the Right Tax Authority

When a Malaysian payer wants to apply treaty treatment to a payment made to an overseas recipient, this generally requires a residency certificate issued by the tax authority in the recipient’s home jurisdiction, together with the underlying contract and transaction records. Malaysia’s own Certificate of Residence (COR), by contrast, is what a Malaysian tax resident uses to claim treaty treatment on income earned overseas.

The withholding tax obligation can be triggered at the point a payment is made or credited, not necessarily on the date the bank actually wires the funds. The standard payment deadline and the forms required should be confirmed in advance, and if the supporting documents are not yet available, the withholding obligation should not simply be set aside.

No Withholding on Dividends Does Not Mean No Personal Tax

Starting from year of assessment (YA) 2025, an individual whose total dividend income for the year exceeds RM100,000 may be subject to a 2% tax on the relevant chargeable dividend income, with its own exemptions and calculation rules. This does not mean the paying company automatically withholds 2%, and it does not mean the full dividend amount received is simply multiplied by 2%.

Both residents and non-residents can be affected. For a non-resident, whether an applicable treaty limits Malaysia’s taxing right also needs to be checked, and how the recipient’s home jurisdiction treats the dividend has to be confirmed separately. A treaty’s dividend provisions should not be generalized as something that only matters overseas.

Situations That Are Often Misunderstood

“The invoice says consultancy fee, so withholding 10% is always the safe answer.”

This can misclassify the payment, or overlook where the service is actually performed, applicable exemptions, and treaty conditions. Read the underlying contract first.

“The company didn’t withhold anything on the dividend, so the shareholder has nothing to report.”

Withholding and a shareholder’s own tax liability are not the same thing. The applicable dividend tax and filing obligation still need to be checked separately.

What to Do Next

Before making a payment, gather the contract, the location where the service is performed, what rights are being granted, and the recipient’s residency certificate. Then confirm the payment’s classification, the applicable rate, the deadline, and who bears the tax. If the contract promises the recipient a net-of-tax amount, factor in the extra cost that creates. Actual withholding tax treatment should be confirmed against the specific transaction and the applicable treaty.

Frequently Asked Questions

Is a Treaty Rate Always Lower Than the Domestic Rate?

Not necessarily. Confirm the domestic tax treatment and any exemptions first, then check whether the treaty limits how much the source country can tax.

Is a 10% Rate Always Withheld on Overseas Service Fees?

No. The nature of the payment, where the service is performed, source rules, exemptions, and the applicable treaty can all affect the outcome.

If Dividends Are Not Withheld, Does That Mean No Personal Tax Is Due?

No. The individual dividend tax that applies from YA 2025, along with any statutory exemptions and treaty eligibility, still needs to be assessed separately.
